Terms & Conditions
SECTION 1 — About Us, Our Services & Build Management
1. About Us:
LBV Developments Ltd ("LBV," "we," "us") is a property development consultancy registered in England and Wales, company number 14688351.
LBV provides architectural design and project management services. LBV is not a registered architectural practice under the Architects Registration Board (ARB) and does not hold itself out as, or claim to be, a registered architect. We provide design services in accordance with UK Planning & Building Regulations, and the latest Approved Documents.
2. Our Services:
LBV offers the following services, as agreed in writing with each client before work begins:
-
2.1 Design & Approvals — measured survey, design development, and preparation of planning and/or building regulations drawing packages, including submission to the relevant local authority and responding to reasonable queries raised during that process.
-
2.2 Build Management — on-site advisory services during construction, including contractor sourcing recommendations, site inspections, assessment of completed work against approved drawings, and recommendations on payment release.
3. No Guarantee of Statutory Approval:
LBV will use reasonable professional skill and care in preparing and submitting drawings for planning permission and/or building regulations approval. LBV does not guarantee that any application will be approved. Decisions rest solely with the relevant local authority and are outside LBV's control. Local authority fees are separate from LBV's fees and are non-refundable regardless of outcome.
4. Build Management — Nature of Our Role:
-
4.1 Where a client engages LBV for Build Management, the client contracts and pays the building contractor directly. LBV is not a party to that contract and has no liability for the contractor's workmanship, timekeeping, insurance, solvency, or conduct.
-
4.2 LBV's role is limited to providing professional advice, conducting site inspections at agreed intervals, and making recommendations — including recommendations on when payment milestones should be released. These recommendations are based on reasonable professional judgement at the time of inspection and do not constitute a guarantee, warranty, or certification that the works are free of defects.
-
4.3 The client remains responsible for their own contract with the building contractor, including its terms, dispute resolution provisions, and any warranties given by the contractor directly.
-
4.4 Clients are strongly advised to ensure their building contractor holds appropriate insurance (including public liability) before work begins. LBV can advise on this but the responsibility to confirm it rests with the client.
SECTION 2 — Fees, Client Responsibilities & Intellectual Property
5. Fees and Payment:
-
5.1 Fees for each engagement will be confirmed in writing (quote or proposal) before work begins.
-
5.2 Invoices are payable within 7 days of the invoice date. Late payment may incur interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 where applicable
-
5.3 LBV reserves the right to pause work on any engagement where payment is overdue.
6. Client Responsibilities:
The client agrees to:
-
provide accurate and complete information about the property and project;
-
obtain any necessary legal rights, consents, or permissions required for LBV (and, where applicable, the contractor) to access and work on the site;
-
respond to requests for decisions or information within a reasonable time, since delays on the client's part may affect project timescales for which LBV is not responsible.
7. Intellectual Property:
Drawings, designs, and documents produced by LBV remain the intellectual property of LBV until the relevant invoice has been paid in full. On full payment, the client is granted a licence to use the drawings for the purpose of the agreed project (including planning submission and construction). LBV retains the right to use anonymised project images and descriptions for portfolio and marketing purposes, subject to client agreement on any personal or identifying details, consistent with LBV's Privacy Policy.
SECTION 3 — Liability, Cancellation, Complaints & Governing Law
8. Limitation of Liability:
-
8.1 Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded or limited under English law.
-
8.2 Subject to clause 8.1, LBV's total liability arising out of or in connection with any engagement, whether in contract, tort (including negligence), or otherwise, shall not exceed the total fees paid for the relevant engagement.
-
8.3 LBV is not liable for losses arising from the acts, omissions, insolvency, or poor workmanship of any third-party contractor engaged directly by the client.
9. Cancellation:
-
9.1 Either party may terminate an engagement in writing. The client remains liable for fees for work carried out up to the date of termination.
-
9.2 Where a contract is formed at a distance (for example, via the website enquiry form, without an in-person meeting before the contract is agreed), consumer clients may have a statutory right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
10. Complaints:
If a client is unhappy with any aspect of LBV's service, they should raise this in writing to projects@lbvdevelopments.com in the first instance.
11. Governing Law:
These terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
